The Details

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before purchasing our products or using our services. By accessing or using any “Product” or “Package” you agree to be bound by these Terms. If you disagree with any part of these terms then you may not access our services or products.

If you wish to purchase any “Product” or “Package” made available to you through Ducks in a Row Marketing you may be asked to supply certain information relevant to your purchase including, without limitation, content (which may include print or image) and/or access.

Client assumes full responsibility for any content, images or information used. Client must immediately bring to our attention any content used on their behalf, that they do not own. We assume responsibility to remove that content immediately or as quickly as is reasonably possible.

Payment in full constitutes agreement for contract fulfillment.

“Products” (as defined on Ducks in a Row Marketing) require a 50% deposit (remainder is due on completion of “product”). If we require content or access from you, which is not provided within 45 days, product purchase will be recognized as completed.

Websites include one draft and two revisions at no charge. Client assumes full responsibility for content, images and all contact information used in the new website draft and must alert us of any errors prior to approval. Each of the two revisions will be limited to a maximum of 2 hours. If needed, additional hours will be billed out at our current “Website Changes hourly rate”. If no revisions are received within 45 days of the draft website, this “Product” will be considered complete.
Refunds on deposits paid for “Products”: 50% of deposit will be refunded, if a written request is received within 10 calendar days of deposit.
Our “Packages” (as defined on Ducks in a Row Marketing) are pre-paid monthly by pre-authorized PayPal or auto debit. These services are provided each month, with no written contract. Pre-authorized payment may be cancelled anytime by emailing info@goducks.ca. Please allow 10 days to allow for bank stop payment processes.

No refunds for our “Packages”, which is pre-paid each month and constitutes the full agreement that month.

Limitation of Liability: Notwithstanding any other provisions contained herein, it is understood and agreed that Ducks in a Row Marketing liability to the Client for any and all claims arising out of any purchase, or in any way relating to the Services “Product or Packages”, will be limited to direct damages and/or to the specific performance of any Service “Product or Package” not meeting reasonable Standard of Care and such liability will, in the aggregate, not exceed the sum of the total product price or $1,000 (whichever is lesser).

Ducks in a Row Marketing reserves the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Ducks in a Row Marketing reserves the right to cancel any of “our packages” with any customer at any time for any reason. We do this by not processing the next pre-authorized payment.

Ducks in a Row Marketing reserves the right to increase prices with 30 days notice (Notice shall constitute price change on Ducks in a Row Marketing and/or notice on the last paid invoice received).
